Terms of sale

1. Who you are buying from

The online shop at luciatuzinska.com is operated by encode s. r. o., registered office Račianska 88B, 831 02 Bratislava, Slovak Republic, Company ID (IČO): 51 968 622, Tax ID (DIČ): 2120848873, registered in the Commercial Register of the Municipal Court Bratislava III, Section Sro, Insert No. 131701/B (the "Seller", "we").

The Seller is not a VAT payer (nie je platiteľ DPH). All prices shown are final; no VAT is added.

Contact: info@luciatuzinska.com. Artworks sold through this shop are created by the painter Lucia Tužinská; the contract of sale is concluded with the Seller.

2. What we sell

We sell original paintings, limited-edition fine-art prints and, by individual agreement, commissioned paintings. Every artwork ships with a signed certificate of authenticity.

Each original painting is a unique, handmade object. Prints are numbered limited editions; some editions are hand-embellished, which means individual impressions may differ slightly from one another. Colours on your screen may differ slightly from the physical work — this is a property of display technology, not a defect.

3. Ordering and conclusion of the contract

Orders are placed through the shop's cart and checkout; no customer account is required. Before submitting an order you can review and change its contents. By clicking the order button with an obligation to pay, you make a binding offer to purchase.

The contract is concluded when we confirm your order by email after successful payment. An original painting is reserved for you while your order is being paid; if payment is not completed, the reservation is released and the work becomes available again.

If an item turns out to be unavailable (for example, an original was sold moments earlier through another channel) or an obvious pricing error occurred, we may cancel the order before dispatch and will refund any payment immediately.

4. Prices and payment

All prices are in euro (EUR) and are final. Payment is processed by Stripe; we accept major payment cards and express payment methods offered at checkout (such as Apple Pay and Google Pay). We never see or store your card details.

The artwork is dispatched only after the full purchase price has been received.

5. Shipping and delivery

We ship worldwide from the Slovak Republic. Every shipment is tracked. Shipping costs are calculated at checkout based on the destination and the size of the work, and are shown before you place the order.

Works are usually dispatched within 5 business days of payment; you will receive a tracking number by email. Stated delivery times are estimates by the carriers, not a guaranteed delivery date, but you will receive the goods at the latest within 30 days unless we agree otherwise.

For deliveries outside the European Union, any import duties, taxes and customs or brokerage fees charged in the destination country are the buyer's responsibility.

6. Right of withdrawal — 14-day returns

If you are a consumer, you may withdraw from the contract within 14 days of the day you (or a person designated by you) receive the artwork, without giving any reason.

To withdraw, send us an unambiguous statement (an email to info@luciatuzinska.com is enough) before the deadline expires. You may use the model withdrawal form at the end of these terms, but you do not have to.

You must send the artwork back to us no later than 14 days after notifying us of the withdrawal. Please pack it in its original packaging or equally protective packaging — you are responsible for any diminished value of the artwork resulting from handling beyond what is necessary to inspect it. The direct cost of returning the artwork is borne by you; we strongly recommend a tracked and insured service.

We will refund all payments received from you, including the original standard delivery cost, within 14 days of receiving your withdrawal notice, using the same payment method you used. We may withhold the refund until we have received the artwork back or you have supplied proof of having sent it.

Exception: the right of withdrawal does not apply to commissioned works — artworks made to your specifications or clearly personalised for you.

7. Complaints and liability for defects

We are liable for defects the artwork has at the moment of delivery, in accordance with Slovak law. For consumers, claims may be raised within two years of delivery. Damage caused in transit is our responsibility — please document any damage on arrival (photos of the packaging and the work) and contact us as soon as possible.

To make a claim (reklamácia), write to info@luciatuzinska.com with your order number, a description of the defect and photographs. We will confirm receipt of your claim, and resolve it without undue delay, at the latest within 30 days. Depending on the nature of the defect you are entitled to the remedies provided by law: repair or replacement, and where that is not possible or proportionate, a reasonable price reduction or withdrawal from the contract with a full refund.

Wear or changes resulting from ordinary ageing of art materials, or damage caused by improper handling, hanging or environment (direct sunlight, humidity), are not defects.

8. Alternative dispute resolution

If you are a consumer and are not satisfied with how we handled your complaint, or believe your rights have been violated, you may first contact us at info@luciatuzinska.com seeking redress. If we reject your request or fail to respond within 30 days, you have the right to submit a proposal for alternative dispute resolution under Act No. 391/2015 Coll. to an ADR entity — for this shop, the Slovak Trade Inspection (Slovenská obchodná inšpekcia, www.soi.sk), or another entity on the list maintained by the Ministry of Economy of the Slovak Republic (www.mhsr.sk).

9. Copyright

All artworks are protected by copyright. Purchasing an artwork transfers ownership of the physical object only; it does not transfer any copyright or reproduction rights. The artwork may not be reproduced, publicly communicated or used commercially without the prior written consent of the copyright holder.

10. Personal data

11. Final provisions

These terms and any contract concluded under them are governed by the law of the Slovak Republic, in particular Act No. 108/2024 Coll. on consumer protection and the Civil Code. If you are a consumer residing in another country, you retain the protection of any mandatory provisions of the law of that country.

If any provision of these terms is or becomes invalid, the remaining provisions remain unaffected. We may amend these terms; orders are always governed by the version in force at the time the order was placed.
